Introduction
The principles relating to terminating employment have remained unchanged for many years. Put simply, they state that employers cannot terminate an employee on unjust, harsh, or unreasonable grounds.
The Rudd government’s interpretation of these principles went into operation on 1st July 2009.
You cannot be sacked for the following reasons;
Basic discriminatory reasons include race, colour, sex, sexual preference, age, physical or mental disability, marital status, pregnancy, religion, political opinion, national extraction or social origin (some exceptions apply, such as where it's part of the requirements of the job).
Associations include trade union membership or participation in trade union activities outside working hours or, with the employer's consent, during working hours, non-membership of a trade union, seeking office as, or acting as, a representative of employees.
No action can be taken against you if you are a parent or carer.
You cannot be dismissed for filing a complaint, or participating in proceedings against an employer.
Absence from work is not a reason for dismissal in the following circumstances:

Being absent from work during parental leave;

Temporary absence from work to engage in a voluntary community activity such as jury duty or firefighting.
In these days when record keeping is so important, it is necessary for employers to follow up termination with a termination of employment letter and make sure that the circumstances of dismissal are adequately covered in the employee’s personal file.
